1. Company Information

These Terms and Conditions govern your use of the Anew Sleep ApS webshop and any purchases made through it.

2. Acceptance of Terms

By accessing our webshop and placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, please refrain from using our webshop.

We reserve the right to update these Terms and Conditions at any time. The version in effect at the time of your order will apply to that purchase.

 

3. Products and Orders

3.1 Product Descriptions

We make every effort to ensure that product descriptions, images, and pricing are accurate. However, we do not warrant that product descriptions are complete, reliable, or error-free. If a product is not as described, your sole remedy is to return it in unused condition.

3.2 Availability

All orders are subject to product availability. If a product is out of stock after your order is placed, we will notify you by email and offer an alternative, a delay, or a full refund.

3.3 Order Confirmation

After placing an order you will receive an automated order confirmation email. This constitutes acknowledgement of receipt, not acceptance. A binding contract is formed when we dispatch your order and send a dispatch confirmation.

 

4. Pricing and Payment

All prices on anewsleep.dk are in Euro (€) and include VAT depending on your contry. We accept the following payment methods:

       Shopify payments

 

Payment is not charged until the item is dispatched. If you have ordered multiple items and one is on backorder, the full amount will be charged when the first item is sent. No card fees are applied.

Payments are secured via SSL encryption through Clearhaus/Quickpay.

 

For purchases with an international card, the amount is reserved immediately and released either when we charge it on dispatch, or according to your card issuer’s terms.

 

For ViaBill purchases: you receive your items first, then pay a monthly instalment on the same date each month. Late payments incur a fee. If you cancel your purchase, the ViaBill payment agreement is also cancelled.

 

5. Delivery

5.1 Delivery Timeframe

Orders placed before 14:00 on a business day are dispatched the same day. Delivery is normally within 1–3 business days.

5.2 Carriers

Orders are sent with DHL by default.

5.3 Free Shipping

We always offer a free shipping option for orders over €70.

5.4 Failed Collection

If your parcel is not collected from the pick-up point in time and is returned to us, we will happily reship it. A re-delivery fee of €7 will apply. You will receive a payment link and the parcel will be sent once payment is received.

5.5 Risk and Title

Risk in the products passes to you upon delivery. Title passes to you upon receipt of full payment.

 

6. Returns, Refunds & Satisfaction Guarantee

6.1 Statutory Right of Withdrawal (EU Consumer Right)

In accordance with the EU Consumer Rights Directive and the Danish Consumer Contracts Act (Forbrugeraftaleloven), you have the right to withdraw from your purchase within 14 calendar days without giving any reason. The withdrawal period begins the day after you receive your order.

If an order contains multiple items delivered separately, the period runs from the day you receive the last item.

If the deadline falls on a public holiday, Saturday, Constitution Day (Grundlovsdag), Christmas Eve, or New Year’s Eve, it is extended to the following business day.

6.2 How to Return

To exercise your right of withdrawal or satisfaction guarantee, follow these steps:

1.      Pack the product securely in its original packaging, with the order number clearly marked on the parcel.

2.     Email hej@anewsleep.com stating whether you wish to return, exchange, or make a warranty claim.

3.     We will send you a link to our returns portal, where you can select a return or exchange for another product or size.

4.     Once we receive and inspect the parcel, you will receive your refund.

 

Items may not be sent cash on delivery or without a delivery address.

6.4 Refund

When you withdraw from a purchase, we refund all payments received from you, with the following exceptions:

       If you only cancel part of a multi-item order, the original delivery cost is not refunded.

       If you selected a more expensive delivery option than our cheapest available, the surcharge is not refunded.

 

We will process the refund without undue delay and no later than 14 days from receipt of your cancellation notice. We may withhold the refund until we have received the goods or proof of return shipment. Refunds are made using the same payment method as the original transaction.

 

Note: If your order included a quantity discount and a partial return means the discount threshold is no longer met, the discount will be adjusted accordingly. Example: Product A costs €70 each, or two for €120. If you return one, you receive €50 refunded, not €60.

 

The right of withdrawal applies to private consumers purchasing via anewsleep.com only. It does not apply to business purchases.

6.5 Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to:

       Products personalised or made to your specifications

       Sealed goods that have been opened and are unsuitable for return on hygiene or health grounds

We only accept parcels sent directly to this address. Please include a detailed description of the issue when returning a warranty item.

 

7. Warranty and Defective Products

As a consumer purchasing from us, the European Sale of Goods Act  applies. You have a 24-month warranty right from the date of delivery.

If your complaint is justified, you may be entitled to repair, replacement, a price reduction, or a full refund, depending on the specific situation.

You must complain within a “reasonable time” after discovering the defect. Complaining within two months of discovering the defect will always be considered timely.

If the complaint is valid, we will refund your reasonable return shipping costs. Items must always be sent in adequate packaging. Please retain your proof of postage so we can reimburse your shipping costs.

To make a warranty claim, contact our customer service at hej@anewsleep.com with a detailed description of the defect and photos where possible.

 

8. Discount Codes

Discount codes cannot be combined with other discount codes or special promotions, and cannot be used for the purchase of gift cards, unless otherwise stated.

 

9. Personal Data and Privacy

When you place an order with us, we collect the following information: name, address, phone number, and email address.

We register and pass on only the personal data necessary to deliver your order. Your data is stored with Anew Sleep ApS for five years, after which it is deleted.

We work with a number of partners who store and process data exclusively on our behalf and may not use it for their own purposes. We only work with data processors within the EU or in countries that provide adequate protection for your data.

You have the right to know what data we hold about you. If you believe it is inaccurate, you have the right to have it corrected. In some cases you can request deletion. You may also contact us if you believe your data is being processed unlawfully. Write to us at: hej@anewsleep.dk.

10. Complaints and Dispute Resolution

11. Governing Law

These Terms and Conditions are governed by the laws of Denmark. Any disputes shall be subject to the jurisdiction of the Danish courts.
